ABSTRACT
OBJECTIVES AND CONFLICTS OF THE VALENCIAN MUNICIPAL COOPERATION FUND. SPECIAL REFERENCE TO THE EXCLUSION OF NON-COMPLIANT LOCAL ENTITIES
Objectives: To demonstrate how the cooperation fund should guarantee the financial sufficiency of local governments, even for those local entities that do not meet the eligibility requirements. Methodology: Is both dogmatic and comparative legal, examining state and regional regulations by contrasting Valencian regulations with other unconditional regional funds, as well as analyzing state mechanisms that ensure the future receipt of funds. Results: A conflict is identified between the stated purpose of ensuring funding for local services and the configuration of the Valencian fund as fully unconditional and non-earmarked financing, usable for any purpose. This is compared with other regional legislation, highlighting its most important aspects. Thirdly, state law is used to emphasize that Valencian regional mechanisms do not provide for a system of withholding and subsequent guaranteed receipt of the withheld amounts. Finally, the budgetary complications for the affected local entities are discussed, and solutions to avoid them are outlined. Conclusions: A reform of the legislation governing the Valencian cooperation fund is necessary to ensure that all local entities receive it.
